(UPDATE 2 – 3 p.m.) MANILA, Philippines – The Bureau of Internal Revenue has filed a P38.57-million tax evasion complaint before the Department of Justice against actor Richard Gutierrez for his and his firm’s alleged failure to pay correct taxes five years ago.

The BIR accused Gutierrez and his company, RGUTZ Productions Corporation, of committing two counts of violation of the Tax Code.

The result of the BIR’s matching process showed that the income declared by Gutierrez’s firm worth P311,000 was much smaller than its actual earnings of P39.9 million.

The BIR said Gutierrez’s camp had also failed to file an income tax return in 2012.

The bureau claimed that it had sent its findings in 2013 and again twice this year to Gutierrez and his firm but the agency allegedly did not receive a response from the actor’s camp.

Gutierrez’s lawyer, Marie Glen Abraham-Garduque on Froiay said that the actor “has not received any complaint yet from the BIR.”

“He will answer at the proper forum as soon as he receives it,” she added.
