MANILA – The Supreme Court on Tuesday issued a temporary restraining order stopping the Quezon City government from enforcing an ordinance that led to the revision of real property assessments in the city, effectively increasing existing values from 100% to 500%.
Meeting en banc, the high court also ordered respondents – Mayor Herbert Bautista, the Quezon City Assessor’s Office and the Quezon City Treasurer’s Office – to comment on the matter within 10 days.
In the case docketed as G.R. No. 230651, the Alliance of Quezon City Homeowners’ Association Inc. had assailed Quezon City Ordinance No. 2256 (Series of 2016), approving the fair market value of lands and basic unit construction costs for buildings and other structures for the revision of real property assessments in Quezon City, effectively increasing existing values from 100% to 500%.
This was to be effective in 2017 for lands and in 2018 for buildings and other structures.
A briefer from the office of the SC Spokesperson said the “Court issued a TEMPORARY RESTRAINING ORDER effectively immediately and until further orders from the Court ENJOINING respondents from implementing, collecting upon, or enforcing” the assailed ordinance.
